1. Acceptance of Terms

By accessing or using the Primephila website (the "Site"), including the Primephila expert identification bot (the "Bot") and the waitlist, you agree to be bound by these User Terms & Conditions. If you do not agree, please do not use the Site.

2. Description of the Service

Primephila is a secure, global marketplace connecting discerning collectors and sellers of authenticated philatelic rarities. The Site offers:

• The Primephila Bot, an AI-powered tool that analyzes a photo of a stamp and returns an estimated identification (title, catalog reference, country, year, catalog value, and suggested price).
• A free registered account that lets you list items for sale on the Marketplace, build your private online collection, and purchase items from other sellers.
• A secure checkout process, operated through our payment processor (Stripe), for completing purchases on the Marketplace.
• A waitlist you may join with your email address if you are not ready to register yet.

3. Registration and User Accounts

Registration on Primephila is completely free for both buyers and sellers. Users must provide accurate and verifiable information when creating an account and keep it up to date. We enforce strict data protection protocols to safeguard your information (see our Privacy Policy). Any attempt to create fraudulent accounts, impersonate another person, or circumvent our verification process will result in immediate and permanent suspension.

4. Selling, Fees, and Commissions

Primephila is committed to transparent and fair pricing for sellers:

• Listing: Items can be listed on the Marketplace indefinitely at no upfront cost.
• Commission: A flat 6% commission is applied only upon the successful sale of an item. The commission is calculated on the item price plus, when the buyer selects the seller's offered shipping rate at checkout, the shipping amount as well — sellers receive 94% of that total. If the buyer arranges shipping independently (no seller shipping rate charged), the commission is calculated on the item price alone.
• Evaluation: Basic identification and valuation of stamps using our Primephila expert bot is provided free of charge. The optional deeper "Extended ID" analysis is paid for using prepaid credits, as described in Section 6.

5. The Primephila Expert Bot

The Primephila expert bot provides automated philatelic identification and market estimations based on the objective details visible on the stamp and general philatelic knowledge, using artificial intelligence (Google Gemini models). It is not a certified appraisal and does not replace the judgment of a professional philatelic expert. While we strive for accuracy, the estimations provided by the Bot are for informational and listing purposes only and may contain errors, including incorrect identification or valuation. Sellers are responsible for reviewing and confirming all data before officially publishing an item on the Marketplace, and buyers should independently verify any listing before purchase.

Catalog references. Primephila does not provide, generate or look up catalog numbers published by third parties (including Scott, Stanley Gibbons, Michel and Yvert et Tellier), as those numbering systems are protected by their publishers' copyright. Identified items receive a Primephila Reference Number derived solely from objective public facts. The optional free-text "My catalog reference" field is filled in by the user alone, for the user's own personal use; the user is solely responsible for any external catalog reference entered there and for ensuring such use complies with the rights of the relevant publisher.

6. Extended ID Credits

In addition to the free Basic identification described above, the Site offers an optional deeper analysis ("Extended ID"), which is paid for using prepaid credits. The following terms apply to those credits:

• Nature of credits: Extended ID credits are a prepaid, non-refundable digital service credit. They are sold in fixed packs, currently 10 credits for €2.50 and 50 credits for €10.00.
• Consumption: Each Extended ID identification request consumes 1 credit from the user's balance.
• No expiry, no cash value: Credits do not expire and have no cash value. They cannot be exchanged for cash, transferred to another account, or used for any purpose other than Extended ID identification requests on Primephila.
• Failed requests: If an Extended ID request fails due to a system or processing error on our side, the consumed credit is automatically refunded to the user's balance. No other refunds are issued for credits that have been used.
• Basic ID remains free: Basic identification remains a free service and does not require or consume credits.
• Payment processing: Credit purchases are processed via Stripe. By purchasing credits, the user agrees to Stripe's applicable terms in addition to these Terms.
• Future pricing: Primephila reserves the right to adjust credit pack pricing and composition for future purchases. Credits already purchased retain their value and functionality.

The disclaimers set out in the section on the Primephila Expert Bot above apply equally to Extended ID results: the analysis is automated, is not a certified appraisal, and may contain errors.

7. Fair Use and Rate Limits

To keep the Bot free and available to everyone, we apply a daily usage limit per user/IP address. Attempting to circumvent this limit, or using the Bot for automated, abusive, or commercial data-scraping purposes, is not permitted and may result in access being blocked.

8. Buyer and Seller Protection Policy — 100% Protection Guarantee

We prioritize absolute security for every transaction conducted within the Primephila ecosystem. Payments made through our checkout are securely held in escrow by our payment processor and are only released to the seller once one of the following occurs, whichever happens first:

• The buyer confirms receipt of the item through their account; or
• 3 days have passed since the shipment's tracking information shows the item as delivered, if the buyer has not confirmed receipt in the meantime.

Sellers are required to enter a tracking number or a direct tracking link for each order in the dedicated field on their Sales dashboard as soon as the item is shipped. This information is shown to the buyer and is used to determine delivery status for the purposes of the automatic release described above. Failure to provide tracking information may delay both the buyer's ability to follow their shipment and the automatic release of funds.

In the event of a dispute — for example, a significant discrepancy between the listing description and the item received — please contact us at contact@primephila.com as soon as possible, ideally before any automatic release occurs, so we can review the transaction. Under our 100% Protection Guarantee, confirmed disputes are covered by comprehensive protection for the full purchase price, including shipping costs, in accordance with our policies.

9. Code of Conduct

Users must conduct themselves with integrity. Misrepresenting an item's condition, authenticity, or catalog reference, manipulating prices, or attempting to bypass the Primephila payment gateway to avoid commissions violates our core principles and will result in account termination and, where appropriate, legal action.

10. Images You Upload

When you upload a photo to the Bot, it is processed to generate your identification result. We do not claim ownership over your images. Please only upload images you have the right to share, and avoid including any personal or sensitive information visible in the photo background.

11. Waitlist and Email Data

If you join the waitlist, we store your email address solely to notify you when Primephila launches or with relevant updates about the platform. We do not sell your email address to third parties. You may request removal from the waitlist at any time by contacting us (see Section 15).

12. Intellectual Property

The Primephila name, logo, and Site design are the property of Primephila. All content on the Site is provided for personal, non-commercial use unless otherwise agreed in writing.

13. Disclaimer of Warranties & Limitation of Liability

The Site and the Bot are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. To the fullest extent permitted by law, Primephila shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site or reliance on the Bot's output, including financial decisions made based on an identification or valuation estimate.

14. Modifications to These Terms

Primephila reserves the right to update or modify these Terms and Conditions at any time as the Site and Marketplace evolve. Users will be notified of significant changes via email or an official platform announcement. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The "Last updated" date above reflects the most recent revision.
